4. WETLAND/WATERCOURSE PERMIT REFERRALS PB 22-03 279 Jackson Avenue, Scarsdale, NY A Planning Board Amended Site Plan, Wetland/Watercourse Permit, and Steep Slope Permit application involving the proposed modification of an existing nursery to facilitate constructing a cul-de-sac to reach single-family homes proposed in the City of Yonkers. The applicant proposes to remove and relocate existing retaining walls and modify an existing curb cut on Jackson Avenue. The cul-de-sac is proposed to be approximately 350 feet long and 26 feet wide, within the Town, and the head of the cul-de-sac is proposed to partially be within the City of Yonkers. The applicant proposes four (4) single-family residences, all entirely within the City of Yonkers. The homes are proposed to receive water from Jackson Avenue, and the applicant will have to petition the water district for out of district use. The applicant proposes approximately 2,625 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 278 sq. f.t of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 1,689 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant requires approximately 871 cubic yards of excavation and approximately 2,800 cubic yards of imported fill, requiring a Fill Permit from the Bureau of Engineering. The applicant proposes a slight decrease in impervious surface coverage from 59.9% existing to 55.4% proposed, where 29% is permitted. The Applicant proposes an under-road stormwater management system to handle the runoff from impervious surfaces within the Town; the proposed homes will have stormwater management systems of their own

Based on consideration of the documents presented to the CAC in connection with the application and the meeting discussions, the CAC recommends that the permit be granted, provided THE FOLLOWING CONDITIONS are satisfied:
  1. The recommendations contained in the Staff Report dated March 7, 2024 are adopted.
  2. The Applicant stated the “Jelly Fish Filter” that that will be used will remove and suspend solids and other pollutants such as heavy metals, petroleum, etc. from stormwater runoff. This device requires inspection every six months and after a rain of one inch or more to determine if maintenance is necessary. There the CAC recommends that the maintenance schedule be required and a letter certifying the maintenance has occurred be sent to the Town after each occurrence.
  3. The Applicant revise the plantings at the parcel's southwest property line so that the buffer includes native shade trees, understory trees and evergreen trees instead of just a row of native and non-native evergreens.
  4. The Applicant revise the Plant Schedule to substitute native trees, shrubs and ornamental grasses for the non-native varieties specified in the undeveloped southwest area.
  5. The Applicant include native plants (shrubs and/or ornamental grasses) on the slope down to the east side watercourse to stabilize the slope and to slow and filter stormwater runoff.

  • Monthly/Quarterly CAC Community Recommendations and Tips – D. Maiello will reformat the tips suggested by N. Drain and submit them to Paul Feiner for publication. After such publicatjon, the tips may be published elsewhere, such as in the ECC Newsletter.

  • Plastic Recycling - LS, ND – L. Silverstein reported on The Case Against Plastic Pollution meeting featuring Judith Enck of Beyond Plastics held on March 10.
  • Food Scrap Recycling – AG – no new discussion
  • Solar Energy – M. Britton reported that the public hearing on the new proposed law was closed.
             
6. NEW BUSINESS
  • D. Maiello presented a tutorial on reading site plan documents.
  • The sending of the letter to the Town Board regarding the potential environmental impacts of an access road from Artillery Lane to Edgemont High School was approved.
