Case No. PB 17-34 Greenburgh Project, LLC, 395 Saw Mill River Road Road (P.O. Elmsford, N.Y.) – Preliminary Subdivision, Site Plan, Planning Board Steep Slope Permit & Tree Removal Permit
A work session to discuss the decision of a preliminary subdivision, site plan and Planning Board steep slope permit application for a proposal to subdivide one (1) existing lot, containing an existing self-storage facility (Westy’s), into two (2) buildable lots, for the purposes of constructing one (1) new self-storage facility. An existing, approximately 149,916 sq. ft. self-storage facility (Westy’s) would remain on proposed Lot 1 (296,959 sq. ft.). A new, approximately 98,400 sq. ft., 3-story self-storage facility is proposed to be built on proposed Lot 2 (198,577 sq. ft.). The applicant proposes 19,944 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 13,634 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES), and 11,206 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposes the removal of 359 regulated trees from the subject property, requiring a tree removal permit from the Planning Board. The applicant has proposed the planting of twenty-four (24) new trees, and forty-four (44) new shrubs, as part of its application. The property consists of approximately 495,536 sq. ft. (11.38 acres) and is situated on the west side of Saw Mill River Road at the intersection at Fairview Park Drive and Saw Mill River Road. The property is located in the PD – Nonresidential Planned Development District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.110-15-6.1.

Case No. TB 17-24 Chapter 285 – PD District (Micro-distilleries) – Zoning Text Amendment (Referral from Town Board)
A continuation of a work session (April 4, 2018) to discuss a zoning text amendment referral from the Town Board involving a proposed modification to the list of permitted uses in the PD – Non-Residential Planned Development zoning district, to include “micro-distilleries,” and to provide a definition and off-street parking regulations, in connection with such use. The proposal also involves the removal of the current prohibition on “distillation” with the PD District, to facilitate the proposed zoning code update.

Case No. PB 17-16 609 Saw Mill Petroleum, LLC, 607 Saw Mill River Road (P.O. Elmsford, N.Y.)Amended Site Plan
A work session to consider an amendment to a site plan application previously approved by the Planning Board on February 12, 2018. The applicant is seeking an amendment to the previously approved site plan application based on New York State Department of Transportation’s request to relocate a proposed curb cut for Lot B (self-storage facility) from Rt. 9A (Saw Mill River Road) to Old Saw Mill River Road. The applicant currently is awaiting approval on its related final subdivision application. The properties consist of approximately 115,689 sq. ft. (2.65 acres) and are situated on the west side of Saw Mill River Road approximately 450 feet south of the intersection of Grasslands Road and Saw Mill River Road. The properties are located in the LI - Light Industrial District and are designated on the tax map of the Town of Greenburgh as Parcel ID’s: 7.060-3-7, 8, & 9.

Case No. PB 18-09 Hutch Tarrytown, LLC, 250 Tarrytown Road (P.O. White Plains, N.Y.) – Special Permit (Motor Vehicle Sales)
A work session to discuss a special permit (motor vehicle sales) application, under Section 285-35 of the Zoning Ordinance, for a proposal to convert a 23,870 sq. ft. vacant space, formerly occupied by Joyce Leslie, to a Tesla local customer delivery and education center. No change is proposed to the footprint of the existing building. The applicant proposes the installation of overhead doors at the rear of the building. Currently, the site contains 120 off-street parkig parking spaces, and no change is proposed as part of the project. The property consists of approximately 94,240 sq. ft. and is situated on the north side of Tarrytown Road, at the intersection of Hillside Avenue (NYS Rt. 100) and Tarrytown Road (NYS Rt. 119). The property is located in the UR – Urban Renewal District (Neighborhood Shopping Sub-district) and is designated on the tax map of the Town of Greenburgh as Parcel ID 7.490-302-1.

Case No. PB 18-07 Nesto’s, 24 Tarrytown Road (P.O. White Plains, N.Y.) – Preliminary Subdivision & Amended Site Plan (Pre-Submission Conference)
A pre-submission conference to discuss a preliminary subdivision and amended site plan application consisting of a proposal to construct nine (9) additional parking spaces at an existing delicatessen (Nesto’s Pizza and Deli). The applicant is proposing to purchase New York State owned land located immediately southwest of the subject property, for the purpose of constructing nine (9) additional off-street parking spaces to be utilized for the existing deli. This proposal would require a re-subdivision of the lots, and an amended site plan approval, from the Planning Board. Currently, thirteen (13) off-street parking spaces exist on the property (7 striped parking spaces and 6 parking spaces provided for in the queue associated with the existing drive-thru). It appears that area variances will be required in connection with the proposal, which will be verified by the Building Inspector at the time of formal submission. The property consists of approximately 11,326 sq. ft. and is situated on the northerly side of Tarrytown Road, at the intersection of Tarrytown Road and Old Kensico Road. The property is located in the DS – Designated Shopping District and is designated on the tax map of the Town of Greenburgh as Parcel ID 7.500-310-1.

Case No. PB 18-02 Dunkin’ Donuts, 221 East Hartsdale Aveune (P.O. Hartsdale, N.Y.) – Special Permit (Incidental Dining)
A public hearing to discuss a special permit (incidental dining) application under Section 285-36P of the Zoning Ordinance, for a proposal to install seating for eight (8) persons at four (4) tables in a 1,423 sq. ft. Dunkin’ Donuts establishment. It is noted that the Town Board currently is considering a local law which removes the restriction of a two (2) table maximum. The property consists of approximately 50,000 sq. ft. and is situated on the eastern side of East Hartsdale Avenue, approximately 380 ft. from the intersection of Fisher Street and East Hartsdale Avenue. The property is located in the HC – Hartsdale Center District and is designated on the tax map of the Town of Greenburgh as Parcel ID 8.300-234-4.
 
b.   Case No. PB 17-25 Grogan Subdivision, 19 Lynwood Road (P.O. Scarsdale, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit & Tree Removal Permit
A public hearing to discuss a preliminary subdivision, Planning Board steep slope permit, and tree removal permit application involving the proposed re-subdivision of four (4) existing lots to create two (2) buildable lots, for the purposes of constructing one (1) new single-family residence. Proposed Lot 1 would consist of 7,626 sq. ft. and contain an existing single-family residence (to remain), partially located in the City of Yonkers, and partially located within the Town of Greenburgh. No site work is proposed within the portion of property situated within the City of Yonkers. The only site work proposed on Lot 1 consists of the removal of a small section of patio, in order to comply with zoning setback requirements. Proposed Lot 2 would consist of 12,015 sq. ft., and the applicant is proposing to construct one (1) new single-family residence, with related improvements, on this lot. The applicant proposes 930 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 972 sq. ft. of disturbance on 25-25% slopes (VERY STEEP SLOPES), and 6,100 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES) requiring a steep slope permit from the Planning Board. The applicant proposes the removal of 25 regulated trees from the project site. The applicant has prepared a landscaping plan which proposes the planting of two (2) Flowering Dogwood trees, two (2) Black Tupelo trees, three (3) swamp Azalea shrubs, and four (4) American Holly shrubs. The properties consist of approximately 19,641 sq. ft. and are situated on the west side of Lynwood Road, approximately 210 feet from the intersection of Ardsley Road and Lynwood Road. The properties are located in the R-7.5 One-Family Residence District, and are designated on the tax map of the Town of Greenburgh as Parcel ID: 8.600-418-1, 2, 3 & 4. An approximately 4,725 sq. ft. portion of the total land area (to be situated as part of Proposed Lot 1), is located within the City of Yonkers.

Case No. PB 15-06 Shelbourne, 448 Underhill Road (P.O. Scarsdale, N.Y.) – Site Plan, PB Steep Slope Permit, Wetland/Watercourse Permit & Tree Removal Permit (Town Forestry Officer approval)
A public hearing to discuss a site plan (Planning Board approval), Planning Board steep slope permit, wetland/watercourse permit, and tree removal permit (Town Forestry Officer approval) application for a proposal consisting of the construction of a four (4) story, eighty (80) unit, ninety-four (94) bed, 70,000 sq. ft. assisted living facility building, together with off-street parking, landscaping and related amenities. Presently, the site contains a nursery, which is proposed to be demolished. Primary access to the site is proposed from Sprain Road. The applicant proposes 7,303 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 3,792 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES) and 5,821 sq. ft. of disturbance on 35+% slopes (EXCESSIVELY STEEP SLOPES). The applicant is proposing approximately 46,215 sq. ft. of ground disturbance in the approximately 59,364 sq. ft. of watercourse and adjacent buffer area. The applicant proposes the removal of twenty-five (25) regulated trees from the property as part of the project, and has filed a tree removal permit application with the Town Forestry Officer. On June 22, 2017, the Zoning Board of Appeals granted area variances in connection with the project. On February 28, 2018, the Town Board approved a special permit in connection with the project. The property consists of approximately 165,145 sq. ft. (3.79 acres), and is situated at the intersection of Underhill Road and Sprain Road. The property is located in the R-30 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.330-242-9.
 
9.   ESTABLISH DATE FOR NEXT MEETING
The next scheduled meeting of the Greenburgh Planning Board will be Wednesday, May 2, 2018 and will begin at 8:00 P.M. in the Greenburgh Town Hall Auditorium.
