The Work Session of the Planning Board of the Town of Greenburgh was held on Wednesday, April 4, 2018, in the auditorium of Greenburgh Town Hall, 177 Hillside Avenue, White Plains, New York at 8:00pm. Chairperson Fran McLaughlin called the meeting to order at _____pm.

Case No. TB 17-24 Chapter 285 – PD District (Micro-distilleries) – Zoning Text Amendment (Referral from Town Board)
A work session to discuss a zoning text amendment referral from the Town Board involving a proposed modification to the list of permitted uses in the PD – Non-Residential Planned Development zoning district, to include “micro-distilleries,” and to provide a definition and off-street parking regulations, in connection with such use. The proposal also involves the removal of the current prohibition on “distillation” with the PD District, to facilitate the proposed zoning code update.

Case No. PB 18-02 Dunkin’ Donuts – 221 East Hartsdale Aveune (P.O. Hartsdale, N.Y.) – Special Permit (Incidental Dining)
A work session to discuss a special permit (incidental dining) application under Section 285-36P of the Zoning Ordinance, for a proposal to install seating for eight (8) persons at four (4) tables in a 1,423 sq. ft. Dunkin’ Donuts establishment. It is noted that the Town Board currently is considering a local law which removes the restriction of a two (2) table maximum. The property consists of approximately 50,000 sq. ft. and is situated on the eastern side of East Hartsdale Avenue, approximately 380 ft. from the intersection of Fisher Street and East Hartsdale Avenue. The property is located in the HC – Hartsdale Center District and is designated on the tax map of the Town of Greenburgh as Parcel ID 8.300-234-4.

Case No. PB 18-08 Caspian Realty (Montaage Furniture Gallery), 155 Central Park Avenue North (P.O. Hartsdale, N.Y.) – Amended Site Plan
A work session to discuss a request for an amendment to a condition of a previously issued site plan approval of the Planning Board, dated June 2002, under Case No. PB 00-08. Specifically, the applicant requests an amendment to remove a condition of the prior site plan approval which states, “No commercial vehicles shall be permitted to remain on the premises overnight.” The applicant is requesting permission to allow for one (1) commercial vehicle to be parked on the premises overnight. An approximately 280 sq. ft. (35.1 ft. x 8 ft.) landscaped island is proposed as screening along one side of the proposed overnight vehicle parking area. Five (5) Degroots Spire Eastern Arborvitae evergreen trees are proposed to be planted within the island. The property consists of approximately 84,942 sq. ft. and is situated on the western side of Central Park Avenue North, approximately 120 ft. from the intersection of North Washington Avenue and Central Park Avenue. The property is located in the CA – Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town of Greenburgh as Parcel ID 8.210-155-3.
             
7. OLD BUSINESS
             
a.

 

Case No. PB 15-08 Matera Subdivision, 575 Knollwood Road (P.O. White Plains, N.Y.) – Final Subdivision
A work session to discuss the decision of a final subdivision application involving the subdivision of one (1) tax lot for the purpose of creating two (2) legal, conforming lots. Two existing single-family residences are located on the one, existing lot. The proposed lots would total 24,508 sq. ft. (Lot 1) and 24,610 sq. ft. (Lot 2). The project involves the removal of an existing 1,178 sq. ft. driveway located adjacent to the existing southerly single-family residence on the property, and the construction of one (1) new 1,179 sq. ft. driveway on the south side of this residence. The project involves approximately 100 cubic yards of cut and approximately 0 cubic yards of imported fill. If the final subdivision is approved, each of the two residences would become the principal structure/residence on its respective lot. The property consists of approximately 49,118 sq. ft. and situated on the east side of Knollwood Road (Route 100A) approximately 76 ft. from the intersection of South Manor Drive. The property is located in the R-20 One-Family Residence District and designated on the tax map of the Town of Greenburgh as Parcel ID: 7.330-148-9.
             
b. Case No. PB 17-36 Zappico, Old Colony Road (P.O. Hartsdale, N.Y.)Preliminary Subdivision, PB Steep Slope Permit, Wetland/Watercourse Permit & Tree Removal Permit (2nd Pre-submission Conference)
A second pre-submission conference (1st pre-submission conference held 1/17/18) to discuss a preliminary subdivision, Planning Board steep slope permit, wetland/watercourse permit and tree removal permit application involving the proposed subdivision of two (2) tax lots for the purposes of creating ten (10) new buildable lots with ten (10) new one-family residences. The applicant has submitted a proposed conventional subdivision layout, which conforms to the lot and bulk requirements of the R-10 zoning district. In this scenario, Lots 1-5 would be accessed off Old Colony Road, and Lots 6-10 would be accessed off Pipeline Road. The applicant also has prepared three (3) alternative layouts for the proposed subdivision, which would involve an application to the Town Board to provide a Conservation District (CD) Overlay on the property. Layout A proposes ten (10) total lots, ranging in size from 8,494 sq. ft. (Lot 9), to 18,466 sq. ft. (Lot 3). Access for all ten (10) lots would be provided along Old Colony Road. A conservation easement area approximately 1.5 acres in size is proposed as part of this layout. Layout B proposes ten (10) total lots, ranging in size from 8,494 sq. ft. (Lot 9), to 18,466 sq. ft. (Lot 3). Access to Lots 1-4 would be provided along Old Colony Road, and access to Lots 5-10 would be provided along Pipeline Road. A conservation easement area approximately 1 acre in size is proposed as part of this layout. Layout C proposes ten (10) total lots, ranging in size from 7,744 sq. ft. (Lot 6), to 16,803 sq. ft. (Lot 2). Access for all ten (10) lots would be provided along Pipeline Road. The applicant has not yet identified the approximate size of the conservation easement area as part of this layout scheme. The properties consist of approximately 114,110 sq. ft. and are situated on the east side of Old Colony Road, at the intersection of Midvale Road and Old Colony Road. The properties are located in the R-10 One-Family Residence District, and are designated on the tax map of the Town of Greenburgh as Parcel ID’s: 8.360-259-11 & 12.
             
c. Case No. PB 15-06 Shelbourne, 448 Underhill Road (P.O. Scarsdale, N.Y.) – Site Plan, PB Steep Slope Permit, Wetland/Watercourse Permit & Tree Removal Permit (Town Forestry Officer approval)
A work session to discuss a site plan (Planning Board approval), Planning Board steep slope permit, wetland/watercourse permit, and tree removal permit (Town Forestry Officer approval) application for a proposal consisting of the construction of a four (4) story, eighty (80) unit, ninety-four (94) bed, 70,000 sq. ft. assisted living facility building, together with off-street parking, landscaping and related amenities. Presently, the site contains a nursery, which is proposed to be demolished. Primary access to the site is proposed from Sprain Road. The applicant proposes 7,303 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 3,792 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES) and 5,821 sq. ft. of disturbance on 35+% slopes (EXCESSIVELY STEEP SLOPES). The applicant is proposing approximately 46,215 sq. ft. of ground disturbance in the approximately 59,364 sq. ft. of watercourse and adjacent buffer area. The applicant proposes the removal of twenty-five (25) regulated trees from the property as part of the project, and has filed a tree removal permit application with the Town Forestry Officer. On June 22, 2017, the Zoning Board of Appeals granted area variances in connection with the project. On February 28, 2018, the Town Board approved a special permit in connection with the project. The property consists of approximately 165,145 sq. ft. (3.79 acres), and is situated at the intersection of Underhill Road and Sprain Road. The property is located in the R-30 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.330-242-9.
             
8. ITEMS FOR PUBLIC HEARING & PUBLIC DISCUSSION
             
a. Case No. PB 15-29 Ranjan Subdivision, 18 Castle Walk (P.O. Scarsdale, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit & Tree Removal Permit
A continuation of a public hearing (February 21, 2018) to discuss a preliminary subdivision, Planning Board steep slope permit, and tree removal permit application involving the proposed subdivision of one (1) lot into three (3) lots, for the purpose of creating one (1) additional buildable lot. Proposed Lot A would total 23,231 sq. ft. Proposed Lot B would total 25,162 sq. ft. Proposed Lot C would total 6,809 sq. ft. An existing single-family residence is proposed to remain on Lot A. The applicant proposes the construction of an approximately 4,552 sq. ft. single-family residence, with related improvements, to be located on proposed Lot B. Lot C is proposed for the purpose of creating a private roadway extension, built to Town standards, that would connect to the existing Castle Walk. The applicant proposes 10,340 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 2,975 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES) and 3,679 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposes the removal of nine (9) regulated trees, requiring a tree removal permit from the Planning Board. The applicant has prepared a landscaping plan which includes the proposed installation of: twelve (12) Maple-leaved Viburnum shrubs, eight (8) Pinxter Azalea shrubs, seven (7) New Jersey Tea shrubs, six (6) Mountain Laurel shrubs, nine (9) American Holly shrubs, eighteen (18) Blue Spruce trees, one (1) White Oak tree, and six (6) Greenspire Linden trees. The property consists of approximately 55,203 sq. ft. and is situated on the east side of Castle Walk approximately 490 feet from the intersection of Fort Hill Road. The property is located in the R-20 One-Family Residence District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.530-363-19.10.
             
b. Case No. PB 17-34 Greenburgh Project, LLC, 395 Saw Mill River Road (P.O. Elmsford, N.Y.) – Preliminary Subdivision, Site Plan, Planning Board Steep Slope Permit & Tree Removal Permit
A continuation of a public hearing (February 21, 2018) to discuss a preliminary subdivision, site plan, Planning Board steep slope permit and tree removal permit application for a proposal to subdivide one (1) existing lot, containing an existing self-storage facility (Westy’s), into two (2) buildable lots, for the purposes of constructing one (1) new self-storage facility. An existing, approximately 149,916 sq. ft. self-storage facility (Westy’s) would remain on proposed Lot 1 (296,959 sq. ft.). A new, approximately 98,400 sq. ft., 3-story self-storage facility is proposed to be built on proposed Lot 2 (198,577 sq. ft.). The applicant proposes 19,944 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 13,634 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES), and 11,206 sq. ft. of disturbance on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The applicant proposes the removal of 311 regulated trees from the subject property, requiring a tree removal permit from the Planning Board. The applicant has proposed the planting of twenty-four (24) new trees, and twenty-five (25) new shrubs, as part of its application. The property consists of approximately 495,536 sq. ft. (11.38 acres) and is situated on the west side of Saw Mill River Road at the intersection at Fairview Park Drive and Saw Mill River Road. The property is located in the PD – Nonresidential Planned Development District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.110-15-6.1.
             
9. ESTABLISH DATE FOR NEXT MEETING
The next scheduled meeting of the Greenburgh Planning Board will be Wednesday, April 18, 2018 and will begin at 8:00 P.M. in the Greenburgh Town Hall Auditorium.
