The Work Session of the Planning Board of the Town of Greenburgh was held on Wednesday, May 16, 2018, in the auditorium of Greenburgh Town Hall, 177 Hillside Avenue, White Plains, New York at 8:00pm. Chairperson Fran McLaughlin called the meeting to order at _____pm.

Case No. TB 17-25 Chapter 285 – Supplementary Use Regulations (Public Hearing Noticing) – Zoning Text Amendment (Referral from Town Board)
A work session to discuss a Planning Board report and recommendation in connection with a Town Board referral of a proposed local law to amend Section 285-38 of the Code of the Town of Greenburgh, entitled “supplementary use regulations.” Following recommendations made at joint meetings of the Town Board and the Planning Board, the Town Board of the Town of Greenburgh finds it in the best interest of the Town to amend Sectioin 285-38 of the Code of the Town of Greenburgh, to establish signage requirements for public hearings related to Land-Use Board applications, in an effort to ensure broader related public notification and participation.

Case No. TB 18-09 Chapter 285 – LOB District (Dance, Music, & Instrumental Music Schools) – Zoning Text Amendment (Referral from Town Board)
A work session to discuss a Planning Board report and recommendation in connection with a Town Board referral of a proposed local law to amend Section 285-27 of the Code of the Town of Greenburgh, entitled “LOB Limited Office Building,” to remove a restriction of dancing, music and instrumental music schools in the LOB District.

Case No. PB 18-09 Hutch Tarrytown, LLC, 250 Tarrytown Road (P.O. White Plains, N.Y.) – Amended Site Plan & Special Permit (Motor Vehicle Sales)
A work session to discuss the decision of an amended site plan application and a special permit (motor vehicle sales) application, under Section 285-35 of the Zoning Ordinance, for a proposal to convert a 23,870 sq. ft. vacant space, currently and formerly occupied by Joyce Leslie and other tenants, to a Tesla local customer delivery, education and motor vehicle sales center. No change is proposed to the footprint of the existing building. The applicant proposes: (1) the inclusion of five (5) overhead bay doors to the building, which would include minor curbing modifications; (2) the consolidation of the ADA compliant parking spaces on the site, into one (1) area, at the front of the building; (3) the installation of three (3) Tesla supercharging stations within the parking lot; and, (4) the removal of a small section of curbing to facilitate access to the site for truck deliveries. Currently, the site contains 120 off-street parking spaces, and no change is proposed as part of the project. The property consists of approximately 94,240 sq. ft. and is situated on the north side of Tarrytown Road, at the intersection of Hillside Avenue (NYS Rt. 100) and Tarrytown Road (NYS Rt. 119). The property is located in the UR – Urban Renewal District (Neighborhood Shopping Sub-district), and is designated on the tax map of the Town of Greenburgh as Parcel ID 7.490-302-1.

Case No. PB 18-03 Nukho, 16 Rock Hill Lane (P.O. Scarsdale, N.Y.) – Planning Board Steep Slope Permit
A continuation of a work session (May 2, 2018) to discuss a Planning Board steep slope permit application involving the proposed demolition of an existing single-family residence, in order to construct one (1) new, single-family residence, a terrace, covered porch, and in-ground pool, with related improvements. The applicant proposes 3,458 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 1,220 sq. ft. of disturbances on 25-35% slopes (VERY STEEP SLOPES) and 2,399 sq. ft. of disturbances on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 457 cubic yards of cut and 550 cubic yards of imported fill, requiring a fill permit from the Bureau of Engineering. The applicant is proposing two (2) CULTEC systems to manage stormwater runoff. The property consists of approximately 52,459 sq. ft. and is situated on the east side of Rock Hill Lane approximately 950 feet from the intersection of Underhill Road and Rock Hill Lane. The property is located in the R-20 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.350-252-53.
             
e. Case No. PB 15-06 Shelbourne, 448 Underhill Road (P.O. Scarsdale, N.Y.) – Site Plan, Planning Board Steep Slope Permit, Wetland/Watercourse Permit & Tree Removal Permit (Town Forestry Officer approval)
A work session to discuss the decision of a site plan (Planning Board approval), Planning Board steep slope permit, and wetland/watercourse permit application for a proposal consisting of the construction of a four (4) story, eighty (80) unit, 59,097 sq. ft. assisted living facility building, together with off-street parking, landscaping and related amenities. Presently, the site contains a nursery, which is proposed to be demolished. Primary access to the site is proposed from Sprain Road. The applicant proposes 7,303 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES), 3,792 sq. ft. of disturbance on 25-35% slopes (VERY STEEP SLOPES) and 5,821 sq. ft. of disturbance on 35+% slopes (EXCESSIVELY STEEP SLOPES). The applicant is proposing approximately 46,215 sq. ft. of ground disturbance in the approximately 59,364 sq. ft. of watercourse and adjacent buffer area. The applicant proposes the removal of twenty-five (25) regulated trees from the property as part of the project, and has filed a tree removal permit application with the Town Forestry Officer. On June 22, 2017, the Zoning Board of Appeals granted area variances in connection with the project. On February 28, 2018, the Town Board approved a special permit in connection with the project. The property consists of approximately 165,145 sq. ft. (3.79 acres), and is situated at the intersection of Underhill Road and Sprain Road. The property is located in the R-30 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.330-242-9.
             
7. NEW BUSINESS
             
a. Case No. PB 18-06 Edgemont Apartments, 370-372 Central Park Avenue (P.O. Scarsdale, N.Y.) – Planning Board Steep Slope Permit
A work session to discuss a Planning Board steep slope permit application consisting of the proposed replacement of a failing railroad tie wall and a partially fallen rock wall, with new, Uni-lock block walls. The applicant is proposing the addition of pre-cast drywells to manage stormwater runoff from existing impervious surfaces. The applicant proposes 3,500 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES) and 1,000 sq. ft. of disturbances on 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 55 cubic yards of cut and 0 cubic yards of imported fill. The property consists of approximately 260,500 sq. ft. and is situated on the east side of Central Park Avenue South approximately 1000 feet from the intersection of Dromore Road and Central Park Avenue South. The property is located in the CA Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.350-254-11.

Case No. PB 17-24 Nakamura Subdivision, 2 Maple Avenue (P.O. Hartsdale, N.Y.) – Preliminary Subdivision
A public hearing to discuss a preliminary subdivision and tree removal permit application involving the proposed subdivision of one (1) existing lot to create two (2) lots, for the purpose of constructing one (1) new single-family residence, with related improvements. Proposed Lot 1 would consist of 16,335 sq. ft. and would include an existing residence, to remain. Proposed Lot 2 would consist of 12,093 sq. ft. The applicant proposes to construct one new single-family residence on Lot 2. The applicant proposes the removal of one (1) regulated tree from the subject property, requiring a tree removal permit through the Planning Board. On April 19, 2018, the Zoning Board of Appeals granted three (3) area variances, and denied one (1) area variance, in connection with the project (ZBA Case No. 17-34). The property consists of approximately 28,428 sq. ft. and is situated on the east side of Maple Avenue, at the intersection of Hillcrest Road and Maple Avenue. The property is located partially in the R-7.5 One-Family Residence District, and partially in the R-10 One-Family Residence District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.250-187-9.
 
             
c. Case No. PB 18-05 Sherwin, 367 Evandale Road (P.O. Scarsdale, N.Y.) – Planning Board Steep Slope Permit
A public hearing to discuss a Planning Board steep slope permit application for a proposal consisting of the re-grading of the front yard area of the subject property. The applicant proposes 1,333 sq. ft. of disturbance on 15-25% slopes (STEEP SLOPES). The applicant currently is in the process of constructing a single-family residence on the property. Approximately 600 cubic yards of fill associated with the pre-existing site excavation will be utilized to re-grade the front yard area. The property consists of approximately 34,513 sq. ft. and is situated on the easterly side of Evandale Road, approximately 337 feet from the intersection of Underhill Road. The property is located in the R-30 One-Family Residence Zoning District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.340-248-9.
             
9. ESTABLISH DATE FOR NEXT MEETING
The next scheduled meeting of the Greenburgh Planning Board will be Wednesday, June 6, 2018 and will begin at 8:00 P.M. in the Greenburgh Town Hall Auditorium.
