Town of Greenburgh Board of Ethics

Board Members Present: Doris Friedman, Esq.; David Schwartz; Tim Hays; Trudy Holand; Blase J. Spinozzi
Volunteer Counsel: Joseph Malara, Esq.
Also present: Members of the public.

The meeting was convened at 6:30 p.m. A quorum of the Board of Ethics was present.

Adopted the agenda.

Adopted the minutes of the January 14^th, 2020 meeting.

2019 Annual Report. Annual report adopted after agreeing on minor corrections.

Ethics Training. Nothing to report at this time.

Financial Disclosure Forms. Nothing to report at this time.

Proper Communication with Board of Ethics. Members of the public, particularly those who have matters pending before the board, were requested to refrain from any ex parte communications with the board dealing with their pending matters.

No new correspondence.

Public Comments. Mr. Samis addressed the BOE with reference to its decision to conduct deliberations regarding the two citizen complaints before the board in executive session. Mr. Samis also commented on the absence of a revised Financial Disclosure Form; to wit, he was informed that a revised FDF is presently before the Town Board and will be made public once it is approved.

The next meeting of the BOE will be at 7 p.m., Thursday, March 19, 2020.

Upon motion, the board retired to executive session to discuss the citizen complaints before the board.

The BOE reconvened after the executive session at 8:40 p.m. After motion, the BOE voted unanimously to have interrogatories prepared and sent to Mr. Lederer-Plaskett in reference to his citizen’s complaint.

The BOE agreed it was prepared to render a decision in the Samis v. Jones citizen complaint without further investigation, and after motion voted unanimously to offer
Respondent Jones the opportunity for a Stage II hearing, or to waive further proceedings and await the BOE’s decision.

Meeting adjourned at 8:45 p.m.
