Case No. PB 24-09 Chao, Clayton Road (P.O. Scarsdale, N.Y.) – Preliminary Subdivision, Wetland/Watercourse 
Permit, and Tree Removal Permit

A continued work session (February 5, 2025) to discuss Preliminary Subdivision, Wetland/Watercourse Permit, and 
Tree Removal Permit application consisting of the subdivision of one (1) lot into three (3) lots to facilitate the 
construction of two (2) new single-family homes, and related improvements. The homes are proposed to have access 
on Clayton Road via a separate lot with a shared private roadway, improved to meet the NYS Fire Code. A watercourse 
runs across the property’s frontage with Clayton Road and a Wetland/Watercourse Permit is required. The Applicant 
proposes approximately 1,000 cubic yards of excavation and no imported fill. The Applicant proposes the removal of 
19 regulated trees, requiring a Tree Removal Permit from the Planning Board, and has prepared a landscaping plan 
providing for the planting of nine (9) trees, as replacement. The Building Inspector has determined that the following 
area variances are required: (1) Lot 1 street frontage, from 25 feet (required) to 0 feet (proposed); (2) Lot 2 street 
frontage, from 25 feet (required) to 0 feet (proposed); (3) Lot 3 driveway setback from west property line, from 18 feet 
(required) to 15 feet (proposed); and (4) Lot 3 driveway setback to east property line, from 18 feet (required) to 15 feet 
(proposed). This property previously received Final Subdivision and Wetland/Watercourse Permit approvals to 
combine three (3) tax lots into the one lot that now exists, as part of Case No. PB 22-10. That project involved the 
proposed construction of one (1) new single-family home, for which a Building Permit was never applied for. The 
property consists of approximately 89,841 sq. ft. (2.06 acres) and is situated on the easterly side of Clayton Road, 
approximately 450 feet north of the intersection of Clayton Road and Sheridan Road. The property is located in the R30 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.400-
281-31.

Case No. PB 25-02 Sultana, 742 Central Park Avenue South (P.O. Scarsdale, N.Y.) – Planning Board Shared Parking Reduction
A work session to discuss the decision of a Planning Board Shared Parking Reduction request to facilitate the 
conversion of approximately 716 sq. ft. of existing, vacant office space into retail bakery space. The conversion would 
increase the required off-street parking amount to 56 parking spaces, where 55 parking spaces are currently required 
and 16 exist, necessitating a shared parking reduction of one (1) parking space. The Applicant proposes to convert the 
office space into a takeout only bakery use which will not have any seating for customers. No external physical changes 
to the site are proposed. The property consists of approximately 15,682 sq. ft. (0.36 acres) and is situated on the easterly 
side of Central Park Avenue South, at the northeast corner of the intersection of Central Park Avenue South and Mt. 
Joy Avenue. The property is located in the CA Central Avenue Mixed-Use Impact District and is designated on the tax 
map of the Town of Greenburgh as Parcel ID: 78.460-329-3.
 
5. NEW BUSINESS WORK SESSION
 
a.  

 

Case No. PB 24-13 Taco Bell, 57 Central Park Avenue North (P.O. Hartsdale, N.Y.) – Site Plan, Special Use Permit (Quick Service/Fast Food Establishment), Planning Board Steep Slope Permit, Wetland/Watercourse Permit, and Tree Removal Permit
A work session to discuss a Planning Board Site Plan, Special Use Permit (Quick Service/Fast Food Establishment), 
Planning Board Steep Slope Permit, Wetland/Watercourse Permit, and Tree Removal Permit application involving the 
proposed construction of a new Taco Bell Quick Service Restaurant on an existing lot. The lot is currently improved 
with a restaurant building, which is proposed to be removed. The Applicant proposes to construct an approximately 
1,688 sq. ft. Taco Bell restaurant, with a drive-through lane capable of stacking up to 8 vehicles. The Applicant proposes 
approximately 584 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 126 sq. ft. of disturbance 
to 25-35% slopes (VERY STEEP SLOPES), and approximately 1,543 sq. ft. of disturbance to 35%+ slopes 
(EXCESSIVELY STEEP SLOPES). The project requires approximately 172 cubic yards of excavation and 179 cubic 
yards of imported fill, requiring a Fill Permit from the Town Engineer. In a memorandum dated February 12, 2025, the
Building Inspector identified the following required area variances: (1) building height, from 12 feet (permitted) to 
15.4 feet (proposed); (2) floor area ratio, from 0.015 (permitted) to 0.09 (proposed); (3) impervious surface coverage, 
from 60% (permitted) to 72% (proposed); (4) side yard setback, from 20 feet (required) to 14.1 feet (proposed); (5) 
front yard setback to off-street parking, from 20 feet (required) to 1.7 feet (proposed); (6) side yard setback to off-street 
parking, from 10 feet (required) to 2 feet (proposed); (7) setback from off-street parking to principal building, from 10 
feet (required) to 0 feet (proposed); and (8) off-street parking spaces, from 49 (required) to 31 (proposed). The Building 
Inspector additionally identified that front, north side, and south side yard landscape buffer waivers and a landscaped 
island every 15 spaces waiver are required from the Planning Board. The Applicant proposes to remove nine (9) 
regulated trees, requiring a Tree Removal Permit, and is preparing a landscaping plan. The site is currently served by 
two (2) curb cuts on Central Park Avenue North, which are proposed to be consolidated into one (1) curb cut. The 
property consists of approximately 17,755 sq. ft. (0.41 acres) and is situated on the westerly side of Central Park Avenue 
North, approximately 150 feet south of the intersection of Central Park Avenue North and Lawton Avenue. The 
property is located in the CA Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town 
of Greenburgh as Parcel ID: 8.250-184-6.

Case No. PB 25-07 Zamudio, 32 Central Park Avenue North (P.O. Hartsdale, N.Y.) – Site Plan and Planning Board Steep Slope Permit
A pre-submission conference to discuss a potential future Planning Board Site Plan and Planning Board Steep Slope 
Permit application for the construction of a multi-tenant commercial building on a vacant lot. The proposed building 
would be split into five (5) separate tenant spaces and total approximately 4,600 sq. ft. of gross floor area. The building 
would require 23 off-street parking spaces. The Applicant has prepared plans providing for 10 off-street spaces. 
Disturbances to steep slopes are anticipated, but have not been calculated yet. The Applicant has identified that area 
variances for side and rear yard setbacks, off-street parking, and floor area ratio may be required. The Applicant 
received approvals for a multi-story office building as part of Case No. PB 13-23, but that project was never built. The 
property consists of approximately 10,000 sq. ft. (0.23 acres) and is situated on the easterly side of Central Park Avenue 
North, approximately 370 feet north of the intersection of Central Park Avenue and East Hartsdale Avenue. The 
property is located in the CA Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town 
of Greenburgh as Parcel ID: 8.250-190-7.2.

The next regularly scheduled meeting of the Greenburgh Planning Board will be held on Wednesday, April 2, 2025 and is scheduled to begin at 7:00 pm.
