This meeting will take place in the Town Hall Auditorium, located at 177 Hillside Avenue, Greenburgh, NY, and will also take place via Zoom. a.  
Case No. PB 24-18 Goldberg, 9 Eastern Road (P.O. Hartsdale, N.Y.) – Minor Project Wetland/Watercourse Permit
A report from the Town Wetlands Inspector concerning a Minor Wetland/Watercourse Permit application involving the expansion of an existing garage and a first-story addition to the rear of the existing house. The first-floor addition involves two (2) new support posts. The wetland/watercourse buffer area on the Applicant’s property consists of approximately 4,323 sq. ft., and the project involves approximately 83 sq. ft. of disturbance within the regulated buffer area. No direct disturbance to the wetland or watercourse is proposed. The project involves approximately 16.6 cubic yards of excavation, and 0 cubic yards of imported fill. The Building Inspector has determined that one (1) area variance is required for the side yard setback to an existing deck, from 5 feet (required) to 2.67 feet (proposed). The subject property consists of approx. 7,500 sq. ft. (0.17 acres) and is situated on the easterly side of Eastern Road, just south of the intersection of Eastern Road and Northern Road. The property is situated in the R-7.5 One-Family Residence District and is designated on the tax map of the Town as Parcel ID: 8.170-105-5.

The Planning Board is a group of volunteers appointed by the Town Board to evaluate land use applications in accordance with the Town Code. When property owners seek to develop their land or make improvements via subdivision or if they will be disturbing an area with a steep slope or within a wetland, watercourse or adjacent, regulated buffer area, they must apply to the Planning Board for approval. It is the job of the Planning Board to balance the rights of land owners while ensuring the adverse impacts to the surrounding community are minimized. Decisions on adjustments to the proposed plan are based on factual evidence and reviewed for consistency with our Town code and Comprehensive Plan. This evidence primarily comes from applicants and their advisors, site visits conducted by Planning Board members, and input from Town staff, the appropriate Fire District, and the public as part of the public hearing process. The relative popularity of an application is not a factor in Planning Board decisions. Decisions are based on the facts presented.

Case No. PB 23-25 Prestigiacomo-Perkins, 7 & 8 Rita Lane (P.O. White Plains, N.Y.) – Preliminary Subdivision
A public hearing to discuss a Preliminary Subdivision Application to resubdivide two (2) existing lots. The existing lots are both improved with a single-family home and driveway. The driveway for 8 Rita Lane encroaches across the property of 7 Rita Lane. The Applicant proposes to shift the side lot line such that the driveway is wholly on the property of 8 Rita Lane. On October 24, 2024, the Zoning Board of Appeals granted the following area variances: (1) for 7 Rita Lane, minimum lot area from 8,878 sq. ft. (existing), 10,000 sq. ft. (required), to 8,713 sq. ft. (approved); (2) for 7 Rita Lane, minimum lot width from 71.1 feet (existing), 100 feet (required), to 64.77 feet (approved); and (3) for 8 Rita Lane, minimum setback from side property line to driveway from 12 feet (required) to 0 feet (approved). One additional area variance, associated with a side yard setback for a driveway on 8 Rita Lane (12 feet required, 2.5 feet proposed), was denied. No site work is proposed as part of this application. The properties consist of approximately 23,237 sq. ft. (0.53 acres) and are situated at the westerly end of Rita Lane, on the cul-de-sac. The properties are located in the R-10 One-Family Residence District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 7.390-199-7 & 8.
 
b.  
Case No. PB 17-09 Preiser, 110 Nepperhan Avenue (P.O. Elmsford, N.Y.) – Site Plan (Re-Approval Request)
A public hearing to discuss a request for re-approval of a previously approved Site Plan application for a project consisting of the demolition of one (1) existing commercial building and the construction of one (1) new, two-story 10,126 sq. ft. multi-use automotive and truck repair facility, with related site improvements. The Applicant is proposing demolition of an existing structure on the property in order to construct a new building three (3) feet above the FEMA established base flood elevation of 177.1 ft. A concrete ramp is proposed to be built to facilitate access into the new building. The project involves approximately 240 cubic yards of cut and approximately 340 cubic yards of imported fill, requiring a Fill Permit from the Town Engineer. The project also requires a Floodplain Development Permit from the Town Engineer. On October 19, 2017, the Applicant obtained required area variances, and a Special Use Permit (satellite parking), from the Zoning Board of Appeals (ZBA). On October 24, 2024 the ZBA modified its previous decision, removing the requirement for satellite parking and approving a plan that provides for twenty-eight (28) off-street parking spaces, where 102 are required. The property consists of approximately 22,500 sq. ft. (0.52 acres) and is situated on the east side of Nepperhan Avenue approximately 150 feet from the intersection of North Payne Street and Nepperhan Avenue. The property is located in the LI Light Industrial District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.180-55-11.
 
5.   OLD BUSINESS
 
a.  
Case No. PB 24-08 Crossroads Shopping Center, 367-459 Tarrytown Road (P.O. White Plains, N.Y.) – Amended Planning Board Shared Parking Reduction
A work session to discuss a request to amend a Planning Board Shared Parking Reduction to facilitate the conversion of approximately 3,498 sq. ft. of existing retail space into restaurant space. The conversion would increase the required off-street parking amount to 1,581 parking spaces, where 1,563 parking spaces exist, necessitating a shared parking reduction of 18 parking spaces. The Applicant previously proposed, and was approved, to convert the entirety of Tenant Space 2, approximately 2,750 sq. ft. in area, into a restaurant use. Tenant Space 2 is located in the eastern portion of the site, between the existing PetSmart and Carter’s stores. The Applicant proposes to convert a portion of Tenant Space 20, approximately 748 sq. ft., into a restaurant use. The rest of Tenant Space 20, approximately 3,619 sq. ft., is already approved as a restaurant use. Tenant Space 20 is located in the western portion of the site, to the immediate east of the existing Party City store. The Applicant now proposes to shift the restaurant space to Tenant Space 25, adjacent to Tiger Shulmann’s, and Tenant Space 39b, adjacent to Dave’s Hot Chicken. The restaurant space of Tenant Space 2 and a portion of Tenant Space 20 would revert to retail. No external physical changes to the site are proposed.
The property consists of approximately 1,181,347 sq. ft. (27.1 acres) and is situated on the southern side of Tarrytown Road and on the northern side of Dobbs Ferry Road. The property is located in the UR Urban Renewal District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.480-295-1 & 2.
 
6.   ESTABLISH DATE FOR NEXT MEETING
The next regularly scheduled meeting of the Greenburgh Planning Board will be held on Wednesday November 20, 2024 and is scheduled to begin at 7:00 pm.
