b.   Case No. PB 23-26 White Plains 450 Realty LLC, 450-460 Tarrytown Road (P.O. White Plains, N.Y.) – Request for Extension of Time to Render a Decision Following the Close of Public Hearing
A request to extend the time for the Planning Board to render a decision following the close of the public hearing associated with a Preliminary Subdivision Application, by 120 days, from November 29, 2024 to March 29, 2025.
 
4.   OLD BUSINESS - WORK SESSION
 
a.   Case No. PB 17-09 Preiser, 110 Nepperhan Avenue (P.O. Elmsford, N.Y.) – Site Plan and Landscape Buffer Waivers
(Re-Approval Request)

A work session to consider a decision on the Applicant’s request for re-approval of a previously approved Site Plan
application and Landscape Buffer Waivers request for a project consisting of the demolition of one (1) existing
commercial building and the construction of one (1) new, two-story 10,126 sq. ft. multi-use automotive and truck repair
facility, with related site improvements. The Applicant is proposing demolition of an existing structure on the property
in order to construct a new building three (3) feet above the FEMA established base flood elevation of 177.1 ft. A
concrete ramp is proposed to be built to facilitate access into the new building. The Applicant has requested the
Planning Board re-approve its prior Landscape Buffer Waivers request on the south side (0 ft.) and rear (0 ft.) of the
subject property. The project involves approximately 240 cubic yards of cut and approximately 340 cubic yards of
imported fill, requiring a Fill Permit from the Town Engineer. The project also requires a Floodplain Development
Permit from the Town Engineer. On October 19, 2017, the Applicant obtained required area variances, and a Special
Use Permit (satellite parking), from the Zoning Board of Appeals (ZBA). On October 24, 2024 the ZBA modified its
previous decision, removing the requirement for satellite parking and approving a plan that provides for twenty-eight
(28) off-street parking spaces, where 102 are required. The property consists of approximately 22,500 sq. ft. (0.52
acres) and is situated on the east side of Nepperhan Avenue approximately 150 feet from the intersection of North
Payne Street and Nepperhan Avenue. The property is located in the LI Light Industrial District and is designated on
the tax map of the Town of Greenburgh as Parcel ID: 7.180-55-11.
 
b.   Case No. PB 23-25 Prestigiacomo-Perkins, 7 & 8 Rita Lane (P.O. White Plains, N.Y.) – Preliminary Subdivision
A work session to consider a decision of a Preliminary Subdivision Application to re-subdivide two (2) existing lots. The existing lots are both improved with a single-family home and driveway. The driveway for 8 Rita Lane encroaches across the property of 7 Rita Lane. The Applicant proposes to shift the side lot line such that the driveway is wholly on the property of 8 Rita Lane. On October 24, 2024, the Zoning Board of Appeals granted the following area variances: (1) for 7 Rita Lane, minimum lot area from 8,878 sq. ft. (existing), 10,000 sq. ft. (required), to 8,713 sq. ft. (approved); (2) for 7 Rita Lane, minimum lot width from 71.1 feet (existing), 100 feet (required), to 64.77 feet (approved); and (3) for 8 Rita Lane, minimum setback from side property line to driveway from 12 feet (required) to 0 feet (approved). One additional area variance, associated with a easterly side yard setback for a driveway on 8 Rita Lane (12 feet required, 2.5 feet proposed), was denied. No site work is proposed as part of this application. The properties consist of approximately 23,237 sq. ft. (0.53 acres) and are situated at the westerly end of Rita Lane, on the cul-de-sac. The properties are located in the R-10 One-Family Residence District and are designated on the tax map of the Town of Greenburgh as Parcel ID: 7.390-199-7 & 8.
 
c.   Case No. PB 24-08 Crossroads Shopping Center, 367-459 Tarrytown Road (P.O. White Plains, N.Y.) – Amended Planning Board Shared Parking Reduction
A work session to discuss a request to amend a previously approved Planning Board Shared Parking Reduction which facilitated the conversion of approximately 3,498 sq. ft. of existing retail space into restaurant space, resulting in an increase in the required number of off-street parking spaces from 1,563 to 1,581, necessitating a shared parking reduction of 18 parking spaces, which was approved on May 16, 2024. In connection with that decision, the Applicant was approved to convert the entirety of Tenant Space 2, approximately 2,750 sq. ft. in area, into a restaurant use and to convert a portion of Tenant Space 20, approximately 748 sq. ft., into a restaurant use. The rest of Tenant Space 20, approximately 3,619 sq. ft., is already approved as a restaurant use. The Applicant now proposes to shift the previously approved restaurant space to Tenant Space 25 (1,980 sq. ft.), adjacent to Tiger Shulmann’s, and Tenant Space 39b (3,515 sq. ft.), adjacent to Dave’s Hot Chicken, which in total, would equal the square footage of the previously approved conversion. The restaurant space of Tenant Space 2 and a portion of Tenant Space 20 would revert to retail. No external physical changes to the site are proposed. The property consists of approximately 1,181,347 sq. ft. (27.1 acres) and is situated on the southern side of Tarrytown Road and on the northern side of Dobbs Ferry Road. The property is located in the UR Urban Renewal District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.480-295-1 & 2.
 
5.   NEW BUSINESS - WORK SESSION
 
a.   Case No. PB 24-22 Levy, 134 Euclid Avenue (P.O. Ardsley, N.Y.) – Preliminary Subdivision, Planning Board Steep Slope Permit, Wetland/Watercourse Permit, and Tree Removal Permit
A work session to discuss a Preliminary Subdivision, Planning Board Steep Slope Permit, Wetland/Watercourse Permit, and Tree Removal Permit application involving the proposed subdivision of one (1) lot into two (2) lots, to facilitate the construction of one (1) new, single-family residence. The existing lot contains an existing one-family residence, which is proposed to remain. There are several off-site encroachments which are proposed to be removed, as identified on the project plans. The Applicant proposes approximately 545 sq. ft. of disturbance to 15-25% slopes (STEEP SLOPES), approximately 238 sq. ft. of disturbance to 25-35% slopes (VERY STEEP SLOPES), and approximately 134 sq. ft. of disturbance to 35%+ slopes (EXCESSIVELY STEEP SLOPES). The project requires approximately 123.8 cubic yards of excavation and 0 cubic yards of imported fill. The Applicant proposes the removal of two (2) regulated trees, requiring a Tree Removal Permit, and is in the process of preparing a landscaping plan to satisfy the requirements of Chapter 260 of the Town Code. An off-site wetland area abuts the southwestern edge of the property and much of the proposed lot is within the regulated buffer area. The Applicant proposes to disturb approximately 9,453 sq. ft. of wetland/watercourse buffer area on the subject property. No direct disturbance to the off-site wetland is proposed. The subject property consists of approximately 22,993 sq. ft. (0.47 acres) and is situated on the southerly side of Euclid Avenue, approximately 500 feet west of the intersection of Euclid Avenue and Faith Lane. The property is located in the R-10 One-Family Residence District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.380-270-3.
 
b.   Case No. PB 24-23 Indy Lab, 1053 Saw Mill River Road (P.O. Ardsley, N.Y.) – Amended Site Plan
A work session to discuss an Amended Site Plan application to construct an outdoor play area associated with a new child daycare use. The Applicant proposes to construct an approximately 1,900 sq. ft. outdoor play area, to be fenced by a six-foot high chain link fence, associated with a proposed 5,400 sq. ft. child daycare center. The daycare use is proposed to accommodate up to 64 children. As part of the outdoor play area construction, 18 off-street parking spaces are proposed to be removed and 7 are proposed to be added, resulting in a net loss of 11 off-street parking spaces. The site requires 145 off-street parking spaces and, with the proposed reduction, would provide 154 off-street parking spaces, meeting Town Zoning Ordinance requirements. The proposed work would reduce the impervious surface coverage from 52.6% to 51.5%, where 65% is permitted. The Applicant has indicated that ten (10) off-street parking spaces will be reserved for parent drop-off from 7:00 am to 9:00 am. The subject property consists of approximately 174,980 sq. ft. (4.02 acres) and is situated on the easterly side of Saw Mill River Road, on the border of the Village of Ardsley. The property is located in the OB-1 Office Business District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.160-101-49.
 
6.   ESTABLISH DATE FOR NEXT MEETING
The next regularly scheduled meeting of the Greenburgh Planning Board will be held on Wednesday, December 4, 2024 and is scheduled to begin at 7:00 pm.
