A continued work session (June 17, 2026 and August 5, 2026) to discuss the issuance of a recommendation to the Town Board on the Amended Site Plan application referral. The project also involves a Town Board Tree Removal Permit application, and an amendment request to a previously-approved Planning Board Steep Slope Permit and Wetland/Watercourse Permit (PB 23-18) associated with proposed modifications to a previously-approved Town Board Site Plan application (TB 23-08). The Applicant received approvals from the Town Board (Site Plan, Tree Removal Permit) on May 8, 2024 and from the Planning Board (Planning Board Steep Slope Permit and Wetland/Watercourse Permit) on June 18, 2024 associated with the construction of an approximately 136,000 sq. ft. logistics building and related off-street parking (208 spaces). The Applicant now seeks to reduce the size of the proposed logistics building to approximately 37,500 sq. ft. and modify the off-street parking layout to reduce the number of spaces provided to 120 off-street parking spaces. The proposed modifications would reduce the amount of disturbance to the site by approximately 1.7 acres, with reductions in disturbance to regulated steep slopes and wetland/watercourse buffer areas. The subject property consists of approximately 39.8 acres (1,735,153 sq. ft.), is located in the PED Planned Economic Development District, and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.71-6-2.2.

The project requires approximately 248 cubic yards of excavation and 69 cubic yards of imported fill. The proposed one-family home would be slightly larger than the existing house, and the Applicant proposes an underground closed detention system to handle stormwater runoff from impervious surfaces. A large tree exists in the right-of-way in front of the house and is proposed to be protected during the course of demolition and construction. The subject property consists of approximately 0.27 acres (11,936 sq. ft.) and is located on the northeasterly side of Joyce Road, approximately 160 feet west of the intersection of Joyce Road and Vista Place. The Planning Board is a group of volunteers appointed by the Town Board to evaluate land use applications in accordance with the Town Code. When property owners seek to develop their land or make improvements via subdivision or if they will be disturbing an area with a steep slope or within a wetland, watercourse or adjacent, regulated buffer area, they must apply to the Planning Board for approval. It is the job of the Planning Board to balance the rights of land owners while ensuring the adverse impacts to the surrounding community are minimized. Decisions on adjustments to the proposed plan are based on factual evidence and reviewed for consistency with our Town code and Comprehensive Plan. This evidence primarily comes from applicants and their advisors, site visits conducted by Planning Board members, and input from Town staff, the appropriate Fire District, and the public as part of the public hearing process. The relative popularity of an application is not a factor in Planning Board decisions. Decisions are based on the facts presented.
