Please Take Notice that the Zoning Board of Appeals of the Town of Greenburgh will hold a Public Hearing
on Thursday, January 19, 2023 at 7:00 p.m. The meeting will take place in the Town Hall auditorium and also
online via Zoom.  If you would like to participate via Zoom please pre-register through the Department of Community Development and Conservation by emailing publichearing@greenburghny.com or calling 914-989-1530, specifying the application(s) that you would like to speak on. Instructions to participate will then be emailed to you.

1.   Case No. ZBA 22-05 Orly Gez, Clarendon Place (P.O. Scarsdale, N.Y.) – Appeal of Building Inspector Determination; Area Variances
The Applicant is appealing a determination of the Building Inspector that variances are required.In the alternative, if its appeal is denied, the Applicant requests area variances from Section 285-15(B)(1) of the Zoning Ordinance to reduce the minimum lot area from 7,500 sq. ft. (required) to 6,105 sq. ft. (proposed); from Section 285-15(B)(2) to reduce the minimum lot width from 75 ft. (required) to 62.5 ft. (proposed), in order to construct a one-family home.The property is located in an R-7.5 One-Family Residence District and is designated on the Town Tax Map as Parcel Lot ID: 8.460-324-8 & 9.

The Applicant is requesting an area variance from Section 240-3C(9) of the Code of the Town of Greenburgh to install a third canopy sign on the subject lot, where only two wall signs are permitted. The property is located in the DS Design Shopping District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 7.490-303-3.

3.   Case No. ZBA 22-38 S&J Service Center, 245 S Central Avenue (P.O. Hartsdale, N.Y.) – Area Variances
The Applicant is requesting area variances from Section 285-29.1C(3) of the Zoning Ordinance to decrease the distance from a detached accessory structure to the front yard from 20 ft. (required) to 10.66 ft. (proposed); and from Section 285-40B(4) of the Zoning Ordinance to increase the height of an accessory structure from 12 ft. (permitted) to 18 ft. (proposed), to construct a canopy over fuel pumps on the subject property. The property is located in the CA Central Avenue Mixed-Use Impact District and is designated on the tax map of the Town of Greenburgh as Parcel ID: 8.290-225-2.

The Applicant is requesting an area variance from Section 240-3C(8) of the Code of the Town of Greenburgh to increase the height of a logo wall sign from 6 ft. (permitted) to 8 ft. (proposed), and from Section 240-3C(8) to increase the stacked height of wall sign from 6 ft. (permitted) to 16 ft. 2.   Case No. ZBA 22-42 One-O-One Realty, 24 Tarrtown Road (P.O. White Plains, N.Y.) – Area Variance Condition Amendment Request
The Applicant is seeking to reopen the prior approval of variances in case no. 13-18 in order to remove or modify condition no. 6 to the variances granted therein, which limited drive-thru services to delis only. In the alternative, applicant seeks a variance to permit it to offer drive-thru services in connection with non-delicatessen operations. The property is located in the DS Design Shopping District and is designated on the Town Tax Map as parcel ID: 7.500-310-1.
 
3.   Case No. ZBA 22-43 Sylvia Emmer, 102 Edgemont Road (P.O. Scarsdale, N.Y.) – Area Variances Approval Extension Request
The Applicant is requesting an extension of expired variances granted on November 19, 2020 as part of ZBA Case 20-25. The Zoning Board of Appeals previously approved area variances from Section 285-16(B)(3)(a) the Zoning Ordinance to increase the maximum building coverage from 30 % (permitted), 37.2 % (existing) to 40.4 % (proposed); from Section 285-16(B)(3)(b) to increase the maximum impervious surface from 43.75 % (permitted), 45.33 % (existing) to 67.3 % (proposed); from Section 285-39(D)(2)(a) to increase the maximum Floor Area Ratio (F.A.R.) from 1,439 sq. ft. (permitted), 2,915 sq. ft. (existing) to 3,135 sq. ft. (proposed); from Section 285-16(B)(4)(a) to reduce the front yard setback from 20 ft. (required), 10.8 ft. (existing) to 12 ft. (proposed); from Section 285-16(B)(4)(b) to reduce one side yard setback from 10 ft. (required), 6.2 ft. (existing) to 6.2 ft. (proposed); from Section 285-(B)(4)(c) to reduce a total of two side yards from 18 ft. (required), 16.2 ft. (existing) to 16.2 ft. (proposed); and from Section 285-42(C)(1) to enlarge a nonconforming structure so as to increase such nonconformance, in order to construct an addition. The property is located in an R-5 One-Family Residence District and is designated on the Town Tax Map as parcel ID: 8.540-376-19.
 
4.   Case No. ZBA 22-44 Michael Montas, 133 Florence Avenue (P.O. White Plains, N.Y.) – Area Variance
The Applicant is requesting an area variance from Section 285-16B(4)(b) of the Zoning Ordinance to reduce the side yard setback from the principal structure from 8 ft. (permitted) to 3.10 ft. (proposed), in order to legalize an addition to an existing residence. The property is located in an R-5/LTF One-Family/Limited Two-Family Residence District and is designated on the Town Tax Map as parcel ID: 7.410-232-2.
